Cannabis became legal in New Jersey on January 1, 2021, with dispensaries starting to sell it on April 21, 2022. While cannabis is legal in the state, it is not a free-for-all. There are rules in place regarding cannabis sales and use. It is important to understand what you can and cannot do.
What You Can Do
Adults 21 or older can legally buy recreational cannabis at alternative treatment centers and dispensaries licensed by the Cannabis Regulatory Commission. Residents as well as visitors can purchase cannabis in New Jersey. You can use cannabis on private property, such as your home or another private place, with permission. Some dispensaries and licensed consumption lounges allow on-site use. Generally, cannabis smoking is allowed where cigarette smoking is permitted.

You can possess up to 6 ounces of cannabis or cannabis products at a time. However, a single purchase is limited to 1 ounce of cannabis flower (or equivalent amounts of concentrates/edibles). This includes:
- 4 grams of solid cannabis concentrates or resin, or the equivalent of 4 grams of concentrate in liquid form.
- 4 grams of vaporized formulations (oil).
- 1000 mg of multiple ingestible cannabis-infused products like gummies.
Adults age 21 or older can gift up to 1 ounce of cannabis to another adult but they cannot receive payment.
What You Cannot Do
You cannot purchase cannabis if you are under 21 years of age. Adults who purchase cannabis for minors can face penalties.
You cannot use, smoke, eat, or vape cannabis on federal lands or smoke in public spaces. This includes streets, parks, beaches, and boardwalks. Many landlords also ban cannabis use.
It is illegal to transport cannabis across statelines, even if the other state has legalized cannabis. This means you cannot transport it via train or place. You also cannot mail it anywhere.
You cannot grow your own cannabis. Growing cannabis at home is illegal for recreational users and medical patients. New Jersey is one of the few legalized states that prohibits personal cannabis cultivation.

You cannot sell cannabis to others. You can gift it in small amounts (mentioned above), but you cannot receive compensation for it.
In addition, you cannot legally drive while high on cannabis. It is considered impaired driving, just like it would be if you were intoxicated by alcohol.
You may be fired from your job for smoking weed, as it is not safe in some work environments. Workplaces have the right to prohibit cannabis at work, and employers do have the right to drug test you as needed.
